Who qualifies for SIJS?

In order to qualify for SIJS: - The child must be under 18 years old at the time the juvenile court order is finalized (21 years old in some states) - The child must be unmarried - The child cannot have committed certain crimes, such as crimes of moral turpitude or drug offenses - The juvenile court proceeding must find that: 1. The child was abused, abandoned, or neglected and is unable to go back to their parent(s); and 2. It is in the best interest of the child to remain in the U.S. and not return to their country of nationality.
