Who will ICE focus on for arrest or deportation during the first 100 days of the Biden presidency?

On 2/18/2021, ICE issued Enforcement Priorities guidelines about who will be targeted for arrest, detention, or deportation during the first 100 days of the Biden presidency. These guidelines will be valid until ICE issues final Enforcement Priorities guidance no later than April 30, 2021. The guidelines explain that ICE will target:

  1. People who ICE believes are engaging in terrorism or spying or who otherwise pose a threat to national security;

  2. People who entered the U.S. without permission on or after November 1, 2020; and

  3. People who ICE believes pose a threat to public safety AND (a) have been convicted of an aggravated felony under the immigration laws; OR (b) have been convicted of a crime involving active participation in a gang; OR (c) is over 16 and intentionally participated in a gang.
